By accessing and using NeuraSafe ("the Service", "the Platform", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. DESCRIPTION OF SERVICE

NeuraSafe is a safety management and compliance platform designed to assist organizations in creating, managing, and maintaining safety documentation, risk assessments, incident reports, and related compliance materials. The Service provides AI-powered document generation, templates, and workflow management tools.

3. USER ACCOUNT AND REGISTRATION

3.1 Account Creation

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

3.2 Account Eligibility

• You must be at least 18 years old to use the Service
• You must have the legal authority to bind your organization to these Terms
• You must comply with all applicable laws and regulations

4. USER RESPONSIBILITIES AND CONDUCT

4.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable local, state, national, or international law or regulation

• Contains malicious code, viruses, worms, or other harmful software

• Contains false, misleading, or fraudulent information

5. USER-GENERATED CONTENT AND LIABILITY

You are solely responsible for all content, data, information, and materials that you input, upload, transmit, or otherwise make available through the Service ("User Content"). You represent and warrant that:

• You own or have the necessary rights, licenses, and permissions to use and authorize us to use all User Content
• Your User Content does not violate any third-party rights, including intellectual property, privacy, or publicity rights
• Your User Content complies with all applicable laws and regulations

5.3 Content Monitoring

While we reserve the right to monitor, review, and remove User Content that violates these Terms, we are under no obligation to do so. We do not pre-screen User Content and assume no responsibility or liability for User Content.

We reserve the right to remove, edit, or refuse to post any User Content for any reason, including but not limited to content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

The Service, including all content, features, functionality, and technology, is owned by NeuraSafe and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 User Content License

By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in connection with the Service.

6.3 Trademarks

All trademarks, service marks, and trade names of NeuraSafe used on the Service are trademarks or registered trademarks of NeuraSafe.

7. SUBSCRIPTION AND PAYMENT TERMS

7.1 Subscription Plans

The Service may offer various subscription plans with different features and pricing. We reserve the right to modify subscription plans, features, and pricing at any time.

7.2 Payment

• Subscription fees are billed in advance on a recurring basis
• All fees are non-refundable except as required by law
• You are responsible for providing accurate payment information
• We may suspend or terminate your account for non-payment

We may offer free trials or free plans. Free plans may have limitations, including but not limited to watermarks on generated documents.

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected
• The Service will meet your specific requirements

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEURASAFE, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEURASAFE ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY:

• Errors, mistakes, or inaccuracies of content
• Personal injury or property damage resulting from your access to or use of the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service

SPECIFICALLY, AND WITHOUT LIMITATION, NEURASAFE SHALL NOT BE LIABLE FOR ANY HARM, DAMAGE, INJURY, OR LOSS RESULTING FROM USER CONTENT THAT CONTAINS INFORMATION ABOUT EXPLOSIVES, WEAPONS, OR OTHER DANGEROUS OR ILLEGAL MATERIALS OR ACTIVITIES.

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless NeuraSafe, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Service
• Your User Content
• Your violation of any third-party rights
• Your violation of any applicable laws or regulations

This indemnification obligation specifically includes, without limitation, any claims, liabilities, damages, or losses arising from User Content that contains information about explosives, weapons, or other dangerous or illegal materials or activities.

12. TERMINATION

12.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion features in the Service.

12.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Your breach of these Terms
• Your use of the Service for illegal or harmful purposes
• Your creation or distribution of prohibited content, including but not limited to content related to explosives, weapons, or other dangerous materials
• Non-payment of subscription fees
• Extended periods of inactivity

12.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and User Content, subject to our data retention policies and applicable laws.

13. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

YOU FURTHER ACKNOWLEDGE THAT YOU UNDERSTAND AND AGREE THAT NEURASAFE IS NOT RESPONSIBLE FOR ANY USER CONTENT, INCLUDING BUT NOT LIMITED TO CONTENT THAT CONTAINS INFORMATION ABOUT EXPLOSIVES, WEAPONS, OR OTHER DANGEROUS OR ILLEGAL MATERIALS OR ACTIVITIES.
